Patient Rights & Responsibilities

Purpose:

This policy describes the rights of patients and identifies how that information is provided to patients. The complete list of Patient Rights and Responsibilities for ProHealth Care Moreland Surgery Center shall be included in the patient handbook.

Policy:

ProHealth Care Moreland Surgery Center respects the rights of the patient and recognizes that each patient is an individual with unique health care needs and, because of the importance of respecting each patient's personal dignity, provides considerate, respectful care focused upon the patient's individual needs.

ProHealth Care Moreland Surgery Center affirms the right of patients to make decisions regarding their medical care, including the decision to discontinue treatment, to the extent permitted by law.

Patients Rights:

  1. Understanding their rights will help the patient get the best possible care. Whenever the law or the patient allows someone else to exercise his or her rights, we will repsect the diecision. 
  2. The patient, or his or her guardian or legally authorized person on the patient’s behalf, has the right to:
    1. Take an active role in his/her healthcare. The patient’s cooperation is important. To provide quality health care, the patient should be part of the health care team.
      1. Race
      2. Creed
      3. Color
      4. National Origin
      5. Ancestry
      6. Religion
      7. Sex or sexual orientation
      8. Marital status
      9. Age
      10. Handicap
      11. Source of payment
    2. Be treated with respect at all times. The patient should expect sensitivity to his/her values, needs and wishes.
    3. Have cultural, psychosocial choices and beliefs respected.
    4. Be informed and make informed decisions. The patient should get complete information. The patient has the right to ask for and receive information about his/her diagnosis, evaluation, treatment and chances for recovery If the patient has any questions or needs more information, he/she has the right to ask.
      1. Guardians and proxies exercise these rights for minors and people under guardianship. However, minors and people under guardianship should make as many decisions as possible.
    5. Provided with the appropriate amount of privacy, receive care in a safe setting, and be free from all forms of abuse or harassment.
    6. Maintain confidentiality regarding disclosures and records, except when required by law, patients are given the opportunity to approve or refuse their release.
    7. Receive clearly written and spoken information. If needed, an interpreter or signer, or any other necessary communication aids the patient needs can be provided.
    8. Informed of their right to change their provider if other qualified providers are available.
    9. Information made available to patients at their request will include:
      1. Patient rights and responsibilities pamphlet
      2. Patient conduct and responsibilities
      3. Services available at the surgery center
      4. Provisions/instructions for after hours and emergency care
      5. Fees for services
      6. Payment policies
      7. Right to refuse to participate in experimental research
      8. Advanced directives, as required by state or federal law and regulations
      9. Credentials of health care professionals
      10. Procedures for expressing suggestions, complaints and grievances.
      11. Information regarding absence of malpractice insurance
    10. Know the identity of all people involved in the provision of care.
    11. Not be recorded or filmed, or request that filming or recording stop.
    12. Receive a copy and full explanation of the bill. Bills should list all charges and costs. Information can be provided on related financial assistance, upon request.
    13. Understand that their physician may have a financial interest in the Surgery Center.

Grievances:

  1. If the patient feels that his/her rights have not been properly respected, the patient can:
    1. Alert a member of the management team
    2. Talk to staff

Patient Responsibilities:

  1. The care a patient receives depends partially on the patient. Thus, a patient has the following responsibilities:
    1. Provide complete and accurate information to the best of his/her ability about his/her current health, medications, including over-the-counter products and dietary supplements and any allergies or sensitivities.
    2. Follow the treatment plan prescribed by his/her provider
    3. Provide a responsible adult to transport him/her home from the facility and remain with him/her for 24 hours, if required by his/her provider.
    4. Be respectful of all the health care providers and staff, as well as other patients.
    5. Accept personal financial responsibility for any charges not covered by his/her insurance.
    6. Inform his/her provider about any living will, medical power of attorney, or other directive that could affect his/her care
